EB-5 (Investor Visa)

What is this visa?

The EB-5 visa is for foreign investors who invest between $800,000 and $1,050,000 in a U.S. business that creates jobs for American workers. This program is designed to attract international investment to boost the U.S. economy and create employment opportunities

  • Example situations:

    • A foreign entrepreneur invests in a U.S. business or a real estate development project, creating jobs for U.S. workers
    • An investor puts money into a qualified commercial enterprise in the U.S. and helps hire local employees, such as in a restaurant or manufacturing company
  • Duration:

    • The investor (and their immediate family members) can obtain a Green Card, allowing them to live and work in the U.S. permanently
    • After 2 years, they must apply to remove the conditions on their Green Card by proving that the investment has been successful and jobs have been created
  • Estimated processing time:

    • Regular processing: 12–24 months (depending on the applicant’s country and the specific project)
    • Processing times may vary depending on the region and the volume of applications

The amount invested must be at least $800,000 in a targeted employment area (a region with high unemployment) or $1,050,000 in a standard area.

E-2 (Treaty Investor Visa)

What is this visa?

The E-2 visa is for foreign investors from countries that have a treaty of commerce and navigation with the U.S. It allows individuals or businesses to invest in a U.S. business and manage or oversee its operations. The E-2 visa is for those who are actively involved in the business

  • Example situations:

    • A business owner from a treaty country opens a restaurant or retail store in the U.S. and manages the day-to-day operations
    • An investor from a country like Japan or Germany opens a manufacturing business in the U.S. and oversees the management of the business
  • Duration:

    • The E-2 visa is typically issued for up to 2 years but can be renewed indefinitely as long as the business is operational and meets the visa requirements
    • It does not lead directly to permanent residency, but it allows the investor to live and work in the U.S. while managing the business
  • Estimated processing time:

    • Regular processing: 2–3 months
    • Processing times can vary depending on the embassy and volume of applications

The E-2 visa is a non-immigrant visa, meaning it does not directly lead to a Green Card, but investors may apply for a change of status later if they want to become permanent residents

L-1 (Intra-Company Transferee Visa)

What is this visa?

The L-1 visa allows employees of international companies to be transferred to a U.S. office. It is commonly used for executives, managers, and employees with specialized knowledge. The L-1 visa allows companies to bring key employees to their U.S. branches or subsidiaries.

    • A manager at a European office of a company is transferred to the U.S. headquarters to oversee operations

Note: The employee must have worked for the company for at least 1 year in the past 3 years at a foreign office before transferring to the U.S.
